User Agreement

    This User Agreement (hereinafter referred to as the "Agreement") regulates the relations between company Stonetalon Limited, hereinafter referred to as the "Rights Holder", and an individual - the User of the Game, hereinafter referred to as the "User", who has agreed to the terms and conditions of this Agreement.

    ATTENTION! IF YOU HAVE STARTED THE GAME PROCESS, YOU CONFIRM YOUR AGREEMENT TO THE TERMS OF THE USER AGREEMENT WITHOUT ANY RESTRICTIONS.

    In case you (User), in accordance with the laws of your country is prohibited to receive online gaming services or there are other legal restrictions, including this online game, according to the current rules of your local legislation, is gambling and, as a consequence, is prohibited in your country, you may not use the Game or individual services in the Game, and undertake to immediately stop using the Game or such services in the Game.

    The User's consent to the provisions of this Agreement is a prerequisite for the use of the Combats game (hereinafter referred to as the "Game"), which is available on the Internet at at the following address: https://combats.com, as well as related information and entertainment resources (collectively, the Game and information and entertainment resources, hereinafter referred to as the "Project").

    The project is any materials placed on the domain name https://combats.com.

    The present Agreement may be updated by the Rights Holder at any time without prior notice.
    The current version of the Agreement is disposed at the address: https://combats.com/TOS.html.

    By accepting the terms and conditions of this Agreement, the User confirms that he has come to 18 years of age, he is capable and competent to conclude this Agreement, that according to the laws of his state, the User does not have any prohibitions and limitations for obtaining the game services on-line. If you are under the age of majority, your parent or legal guardian must consent to this Agreement.

    By this the User is notified that the systematic long (continuous) staying at the personal computer can cause different physical complications including amblyopia, scoliosis, various forms of neurosis and other negative influences for the body. The User guarantees that he will use the Project only during the reasonable period of time with breaks for rest and other activities for preventive care of physical condition if they are recommended and prescribed to the User.

    The User warrants that equipment and communication facilities used by him, including communication operator's services used by the User are adequate and operable for participation in the Project.

    The company Stonetalon Limited, under an exclusive license, is the owner of the rights to the Project, located at: https://combats.com, which is protected by the laws of Hong Kong and international law on the protection of intellectual property and copyright.

    This Agreement has been developed specifically for the "Combats" Project. Any distribution of the text of this Agreement or parts hereof may not be effected unless there is available Rights Holder consent in writing.

1. General provisions

1.1 The Rights Holder provides the User with access to the Project without charging the transmission fee. The User shall himself at his own expense pay up the Internet access.
1.2 The obtaining of additional (paid) services of the Project doesn’t release Users from observation the present Agreement or the Rules of the Project.
1.3 "User" is any person having been given access to the Project according to the present TOS, using the materials placed on the domain name https://combats.com in private manner only for private non-commercial purposes.
1.4 All names, property rights and intellectual property rights in the Project and to the Project (including without exception any names, software (computer program and any files), databases, any text, photographic images, images, graphics as well as any data in visual, audio or audiovisual or other form, themes, characters, names of characters, stories, dialogue, popular phrases, places of location, illustrative material, material values of characters, structural and landscape designs, things (objects), and any documentation referring to this) is the property of the Company Stonetalon Limited under an exclusive license. The User understands and acknowledges that no ownership rights in the Project are transferred or granted to the User, and this Agreement shall not be construed as a sale of any rights.

2. Subject of the Terms of Service

2. According to the terms and conditions of this Agreement the Rights holder grants to the User the possibility to use the Project "Combats" around the clock except the period of maintenance and other circumstances preventing the User from access to the Project arising not through Rights Holder fault.
2.2 The User undertakes to observe the terms and conditions of this Agreement.
2.3 In case of any User’s violation of this Agreement or the Laws/Rules of the Project the User may be refused to have the access to services of the Project or the providing of such services may be limited completely or partially. The User also consents that the Rights Holder is not responsible for any modification, limitation or shutting-off the User access to the Project.

3. Rights and obligations of the User

3.1. Rights of the User

3.1.1 The User has the right to use the Project only for non-commercial personal purposes. You may create an Account only if: you are an "individual person" and of legal age in your country and state of residence (limited liability companies, partnerships and other legal or commercial entities may not create an Account); and you are not a natural person expressly prohibited by the Rights Holder from using the Project.
3.1.2 At registration the User selects a login and a password which will make it possible to identify the User among other users of the Project.
3.1.3 The User has the right to change his password. At the same time the User is bound to provide himself non-disclosure (secret) of his password and other necessary data and accordingly is responsible for integrity and non-disclosure of his password as well as for all risks (losses) connected therewith.
3.1.4 User may register only one character. The User may not share his/her Registration Information (login and password) with a third party, nor may he/she receive it from a third party. You must keep your Login Information confidential because you are responsible for all uses of your Login Information and Account, including purchases, whether or not you have authorized them. If you become aware of or have reason to suspect any breach of security, including but not limited to any loss, theft or unauthorized disclosure of Login Information, you must immediately notify the Rights Holder at https://support.combats.com/. The Rights Holder, in its sole discretion, may require additional information and/or documentation to verify your claim, and once the Rights Holder receives the information it deems necessary to verify your claim, the Rights Holder will take action to block your Account until the Rights Holder returns control of your Account to you. Notwithstanding any action that the Rights Holder may take on your behalf, you acknowledge and agree that the Rights Holder has sole and exclusive discretion to determine the validity of your claim and, if so, may pursue appropriate remedies.
3.1.5. The User may send claims and proposals connected with the use of the Project to the address : https://support.combats.com

3.2. Obligations of the User

3.2.1 On request of the Rights Holder the User is bound to advise the reliable, complete and update information about him permitting to identify him among other Users. If after the registration this information will be changed, the User is obliged to renew it as soon as possible. Any personal User’s information is requested by the Rights Holder only for the purpose to carry out the Agreement and in no circumstances it is passed to the third parties if only as for the purpose to carry out the Agreement or according to the legislation demands.
Persons not having come to 18 years of age shall be bound to coordinate use of the Project with their lawful representatives (parents, custodians, etc.); in addition to this other actions to confirm the age may be necessary.

3.2.2 The User does not have the right:
- to use software errors and is bound to report the same immediately to the address: https://support.combats.com,
- to intrude into the software code,
- to obtain unauthorized access to the computer system, access to the database of the Users of the Project.
3.2.3 The user is strictly forbidden to use and distribute any scripts, clients' programs and third-party software tools that are not provided by the Game and that could provoke:
- uncontrolled gaming consequences;
- facilitation of the gaming process;
- failure of server functioning;
Forbidden software tools are indicated as any software tools (programs, add-ons, plug-ins etc.) created or used for automated or semiautomated reproduction or emulation of player's actions, including macros.
3.2.4 The User undertakes to treat other Users of Project respectfully and correctly, and not to use the Project for:
- uploading, sending, transmitting or any other way of posting content that is illegal, malicious, threatening, defamatory, offends morality, violates copyrights, promotes hatred and/or discrimination of people on racial, ethnic, gender, religious, social grounds, contains insults to specific individuals or organizations;
- infringement of the rights of minors and/or harming them in any form;
- infringement of the rights of minorities;
- impersonating another person or representative of an organization and/or community without sufficient rights to do so, including Company employees, forum moderators, the site owner, as well as misrepresenting the properties and characteristics of any subjects or objects;
- uploading, sending, transmitting or in any other way posting content that you are not authorized to make available under Hong Kong law or under any contractual relationship;
- uploading, sending, transmitting or in any other way posting content that infringes any patent, trademark, trade secret, copyright or other proprietary and/or copyright and related rights of a third party;
- uploading, sending, transmitting or any other way of placing unauthorized advertising information, spam (including search engine spam), lists of other people's e-mail addresses, pyramid schemes, multi-level (network) marketing (MLM), Internet earning systems and e-mail business, etc.
- downloading, sending, transmitting or in any other way posting any material containing viruses or other computer codes, files or programs designed to disrupt, destroy or limit the functionality of any computer or telecommunication equipment or programs, for unauthorized access, as well as serial numbers to commercial software products and programs for their generation, logins, passwords and other means of gaining unauthorized access to paid resources on the Internet.
- willfully violating the laws of Hong Kong or international law;
- collecting and storing personal data of other persons;
- Disrupting the normal operation of the Combats website;
- applying any form or method of unlawful representation of others on the Web;
- placing links to resources on the Web, the content of which is contrary to the laws of Hong Kong;
- facilitating actions aimed at violating the restrictions and prohibitions imposed by the Agreement.
3.2.5 The User is prohibited to copy, reproduce, distribute and translate into other languages any component of the Project, to carry out cracking of the technology, to take out the initial code, to modify, to disassemble, to decompile, or to create derived objects based on the Project, to include any material of the Project into the basis of his own developments. The User accepts and agrees that any material and all necessary programs connected with the Combats Project are protected by the intellectual property laws of Hong Kong and other international laws, and the material (the intellectual property comprising the Project, the exclusive rights to which are licensed to Stonetalon Limited) provided to User in the course of using the Combats Project is protected by copyrights, trademarks, patents and other relevant laws. The User has no right to modify, sell, distribute this material of the Project and the program in whole or in parts. The Rights Holder grants the User a non-exclusive and non-transferable right to personally use the Project material and the software that makes up the Combats Project in accordance with the Project rules, provided that neither the User nor any other persons with the assistance of the User will copy or modify the material and software; create programs derived from the software; penetrate the software in order to obtain program codes; sell, assign, lease, transfer to third parties in any other form the rights in relation to the Project material and the Project software, or modify the service, including for the purpose of obtaining unauthorized access to it. The User understands, accepts and agrees that any element of the Project, in particular any game characters and game paraphernalia, are a component part of the Project, with a certain set of functions and opportunities in the Project, and, despite the fact that the User is allowed to manage such characters and paraphernalia during the gameplay and participation in the Project, including the development of such characters in the course of the Project and gameplay, such management and development of the character in the Project can under no circumstances be considered as a price.
3.2.6. The user is warned and agrees that in case of breach of the User's duties the Rights Holder has the right to apply sanctions that prevent the User from using the Project, delete the character of the User from the Project data base, or to apply any other methods of influence: warning, temporary locking of the User by the Project, claim for damages and other actions.

4. Rights and responsibilities of the Rights Holder

4.1 The Rights holder undertakes not to disclose on purpose personal information about the User given when registered to the third parties except in cases allowed by the Hong Kong law and the Rules of international law, and also not to change the login and password of the User without his consent The Rights Holder rules the Project and Game processes at its sole discretion and determination. In order to collect of statistical data and indentify visitors of the Project the Rights Holder can monitor and save the information about IP-addresses of users to the Project, use cookies disposed at the local terminal of the User.
The Project User agrees that Rights Holder has the right to demand, collect and save personal information of the User, including surname, name, patronymic, sex, age, address of the registered or actual location, contact numbers or e-mail addresses, or any other means of electronic communication, as well as in case the User commands additional (paid) services – payment requisites of the User. The Rights Holder has the right to delete a character or block it (cease access to it) if there are any reasons to doubt that the information provided by the User is not full, authentic or up-to-date.
The Rights Holder does not distribute among the Users baseless electronic mails or other messages (spam); in case of receiving of such a message the User should notify about it to the address: support. combats.
4.2 The Rights Holder does not bear any responsibility for any temporary technical failures and breaks in work of the Project, for temporary failures and breaks in work of connection links, other similar failures, and also for defects of the computer which is used by the User to connect to the Internet.
4.3 The Rights Holder is not liable to the User for the actions of other Users.
4.4 The Rights holder has the right to delete or change any information posted by the User on https://combats.com that is not provided for by this Agreement or other agreements with the Rights holder.
4.5 The Rights Holder does not exchange the game values received through the User's receipt of the Services and/or Additional Services in the Project, including the game payment means, for cash or non-cash money. The Rights Holder does not bear the costs associated with the User's payment for the Additional Services and does not reimburse the User for such costs.
4.6 The Rights Holder independently decides what is considered a violation of this Agreement and has the right to apply the following penalties: at any time suspend, limit and/or terminate the provision of Services, Additional Services to the User; limit, suspend or completely terminate access to the account; delete the character or account; Also, the Rights Holder has the right to warn the User about the violation of the terms of the Agreement, to publish on the Project, including in the relevant Game remarks to the User with the indication of the User's rights and obligations. Notice of termination of the Agreement shall be sent to the User by e-mail from the address https://support.combats.com to the User's address specified in the User's account.
If the User is inactive for a long period of time, the Rights Holder has the right to cancel the User's account.
4.7 The Rights Holder shall be entitled to take such steps as may be required by law in force in Hong Kong and/or international law to protect its own rights in respect of the Project.

5. Disclaimer of warranties

THE USER EXPRESSLY UNDERSTANDS AND AGREES THAT:
(a) HIS USE OF THE SERVICE IS AT HIS SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE RIGHTS HOLDER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY OF THE PROJECT, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. (b) THE RIGHTS HOLDER MAKES NO WARRANTY THAT:
(1) THE SERVICE WILL MEET YOU REQUIREMENTS,
(2) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE,
(3) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OF THE PROJECT WILL BE ACCURATE OR RELIABLE,
(4) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL, PERCHASED OR OBTAINED BY YOU THROUGH USING OF THE PROJECT, WILL MEET YOUR EXPECTATIONS,
(5) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
(c) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE PROJECT IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA OR OTHER LIABILITY THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
(d) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE RIGHTS HOLDER SHALL CREATE ANY WARRANTY NOT EXPRESLY STATED IN THE AGREEMENT.

6. Liability limit

THE USER EXPRESLY UNDERSTANDS AND AGREES THAT THE RIGHTS HOLDER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFIT, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE RIGHTS HOLDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:
(1) THE USE OR THE UNABILITY TO USE THE PROJECT;
(2) CHANGING OF THE CONDITIONS OF THE TOS, OBTAINING THE DATA INSTEAD OF THE ACQUIRED BY MEANS OF SERVICES OR AS A RESULT OF MAKING BARGAINS, MESSAGES AND INFORMATION RECEIVED BY MEANS OF THE PROJECT;
(3) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
(4) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE PROJECT;
(5) ANY OTHER MATTER RELATING TO THE SERVICES OF THE PROJECT.
(6) POSSIBLE UNLAWFUL ACTION BY THE USER AND/OR OTHER USERS
(7) STATEMENTS OF THE USER AND/OR OTHER USERS PRODUCED OR PUBLISHED ON THE PROJECT. FOR THE BEHAVIOR OF THE USER AND/OR OTHER USERS ON THE PROJECT, INCLUDING THE BEHAVIOR, CHARACTER AND IDEOLOGY OF GAME CHARACTERS CONTROLLED BY THE USER, ACTIONS OF GAME CHARACTERS IN THE PROJECT, DISRESPECTFUL ATTITUDE TOWARDS OTHER USERS OF THE PROJECT AND GAME CONTROLLED BY THEM

7. Special conditions

7.1 The Rights Holder reserves the right to delete from its own servers any information or materials which seem to the Rights Holder unacceptable, undesirable or violating the Agreement.
7.2 The Rights Holder has the right unilaterally and at any time to limit, extend or change the quality of the services without any prior notification to the User.
7.3 The Rights Holder has the right unilaterally and at any time to change the conditions of the Agreement and accordingly input the changes to this page. When using the Project service, the User agrees that all changes to the Agreement apply to him of the moment of publication at this page. The User is to visit regularly this page in order to get acquainted with the up-to-date provisions of the Agreement.
7.4 The present Agreement is subject to the Hong Kong law and the Rules of international law. All disputes which may arise out of the Agreement will be settled by means of negotiations. If the Parties do not come to an agreement, the matter is to be submitted for settlement to the relevant legal body determined by the Hong Kong law unless otherwise stipulated by the Rules of international law.
7.5 Other rights of the Rights Holder and obligations of the User are stipulated in the Project Rules.
7.6 Additional Services.
7.6.1 At the User's request, the Rights Holder provides the User with Additional Services, purchased in the in-game store, which provide the User with the opportunity to use additional, extended, special features of the Project.
Unless otherwise stated, a service in any in-game store has the same age category as the Game/Project.
The ways and conditions for purchasing Additional Services, in-game payment means, are set out at are presented on the pages of our partners, the list of which can be seen by clicking on the icon in the user interface of the project.
7.6.2 When making payment for the ADDITIONAL SERVICES, the User undertakes to follow the payment instructions on the procedure and methods of payment. Crediting of the game payment means to the User's personal account is guaranteed if the attached instructions and payment terms are fulfilled. The Rights Holder is not responsible for the correctness of the User's fulfillment of the conditions of payment for Additional Services as being beyond the control of the Right Holder.
The User should contact the Partner regarding the rules and procedure of using payment systems to make payment for the game means of payment. The Rights holder does not explain to the Users the issues related to the rules and order of using the Project, and also does not compensate the User, who made operations on crediting funds for payment of the game payment means, if such payments were made with violations of the rules established by the Partner, as a result of which the funds were not received by the Partner.
7.6.3 In case if as a result of a technical error, or Project failure, or conscious actions of the User the User received Additional services without payment and/or incomplete payment, and/or non-writing of the game payment means from the User's personal account to pay for such Additional services, the Partner has the right to deduct the cost of Additional services received as a result of such circumstances from any subsequent receipts of funds from the User, for whatever purposes these funds were intended.
7.6.4. the User is obliged to independently monitor the status of their personal account.
7.6.5 Additional paid Services are provided exclusively by the Rights Holder. In case of any disputable, unclear situations, or in case of any offers of any third parties related to payment for the Services or Additional Services in the Project, the User is obliged to immediately notify the Rights Holder of such fact. In case the User, in violation of this provision, has made payment under the specified Offer using the data specified in such Offer (including details and/or codes), the User's claims to the Rights Holder or the Partner regarding the failure to receive the game payment means to the User's personal account are not considered and are not compensated by the Right Holder or the Partner.
7.6.6 If the Rights Holder finds out that the User receives Services or Additional Services within the Game from other third parties (physical and/or legal) acting without agreement with the Rights Holder, the latter has the right to suspend, limit or terminate the provision of Services/Additional Services to the User.
7.6.7 The User guarantees to the Rights Holder that he/she has the right to use the means chosen by him/her to pay for the Additional Services without violating the laws of Hong Kong and/or the laws of another country of which the User is a citizen. The Rights Holder is not responsible for any possible damage to third parties and/or other Users of the Game caused as a result of the User's use of payment means that do not belong to him.
7.6.8 The Rights Holder reserves the right to unilaterally suspend or terminate the provision of the Services, Additional Services to the User, if there is a suspicion that the User has committed illegal or fraudulent actions, until the circumstances are clarified, and/or the Rights Holder determines that the User's operations on payment for Additional Services are fraudulent (including fraud, carding) – hereinafter – fraudulent operations.
7.6.9 If the Rights Holder has reason to believe that the User is committing illegal actions or fraudulent actions related to the payment for Additional Services in the Game, the Rights Holder has the right to transfer the relevant information to law enforcement agencies for the purpose of verification of this fact.
7.6.10. The User is obliged to comply with the requirements of the legislation in force in the territory of Hong Kong and/or the legislation of another country, the citizen of which is the User, when paying for the game payment means with the help of bank cards.
7.6.11. The User agrees, understands and accepts that the Project is not a game of chance, money game, contest, betting and that the purchase of Additional Services is his will and desire and is not a necessary or obligatory condition for participation in the Project and gameplay.

8. Effective date and term of the Agreement

THE START OF USING THE PROJECT MEANS ABSOLUTE CONSENT AND ACCEPTANCE OF CONDITIONS AND TERMS BY THE USER REGARDING THE PROVISIONS OF THE PRESENT AGREEMENT.
